Injury Found Not Compensable Despite Video Showing Claimant Falling

Worker compensation claim by man falling and claiming a work injury

The claimant is a male in his late sixties who tripped and fell at work. While an incident occurred at work which was shown via video, the ALJ did not find the claimant credible.

The video showed him falling, but his left knee does not hit the ground. Further, the video of the incident showed the claimant grabbing the opposite knee entirely.

Also, the claimant denied having symptoms in his knee prior to the work incident, and the ALJ agreed with Respondents that the prior medical records showed prior knee issues.

Stolarski v. Oasis Outsourcing, Inc. dba Cobblestone Auto Spa, W.C. No. 5-263-367-001 (Jan. 22, 2025).
