
IN THIS CLAIM, Respondents were issued a penalty for failure to pay the CUE fund as part of an earlier penalty resolution that occurred over six months prior.
This penalty order was part of a series of orders from the Division regarding failure to pay funds into the CUE fund at the time of the penalty or settlement. As with all WCRP penalties, the possible consequence of this missing payment to the CUE fund was up to $1000/day, resulting in a total penalty that may have been well over 6-figures.
Our office was able to mitigate the penalty in its entirety by explaining the factual basis that led to the failure to pay the fund, as well as how we promptly resolved outstanding penalty awards with the claimant in order to cure any deficit to the claimant itself, resolving any outstanding balances or problems.
